Terms and SMS Terms
These terms govern your use of Mutual Spark, operated by FMF Consulting LLC. By using the service, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service.
Eligibility and accounts
You must be at least 18 years old and legally able to agree to these terms. You are responsible for accurate account information, your account credentials, and activity conducted through your account or verified mobile number.
Purpose of Mutual Spark
Mutual Spark provides tools for privately expressing interpersonal interest and identifying reciprocal requests. A request does not guarantee a match, response, relationship, identity, compatibility, safety, or outcome. Mutual Spark is not an emergency, background-check, or identity-verification service.
Respectful and lawful use
You may submit only genuine requests involving people you know or have a legitimate reason to identify. You may not use Mutual Spark for harassment, threats, impersonation, stalking, discrimination, fraud, spam, unlawful surveillance, or to submit another person’s information without a lawful basis. We may restrict or terminate access to protect users and the service.
SMS program terms
By affirmatively checking the SMS consent box and initiating a message, you agree to receive transactional texts from Mutual Spark concerning your account, connection requests, confirmations, and matches. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
Reply STOP to opt out. Reply HELP for help, or contact [email protected]. Consent to SMS is not a condition of purchase. After opting out, you may receive one final confirmation message. You may re-enroll through a supported opt-in process.
Early-access limitations
Features may be experimental, incomplete, changed, suspended, or discontinued. During the SMS demonstration, only verified users are supported and unregistered targets are not sent connection invitations.
Privacy and intellectual property
Our handling of personal information is described in the Privacy Policy. Mutual Spark’s software, designs, names, logos, and content are owned by or licensed to FMF Consulting LLC and may not be copied or exploited without permission.
Disclaimers and limitation of liability
To the extent permitted by law, the service is provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, availability, matching success, or fitness for a particular purpose. To the extent permitted by law, FMF Consulting LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the service or interactions between users.
Changes and contact
We may update these terms by posting a revised effective date. Continued use after an update constitutes acceptance where permitted by law. Questions may be sent to [email protected].
